PREAMBLE

This contract constitutes a legal agreement between the user of the JobsMedia.ca website and affiliated websites, including but not limited to: LeMarché.coTonMétier.comComptaFinance.comEmploisTI.comEmploisRH.caLaVente.ca, EducEmplois.com, LesJuristes.ca, DentR.ca, and other platforms of the JobsMedia.ca network (these websites together hereinafter referred to as the “website”) related to the use of said “website”.

 

PLEASE READ THESE CONDITIONS CAREFULLY BEFORE ACCESSING THE WEBSITE

By navigating this “website”, you agree to be bound by the Conditions of Use and posting methods of the current contract, as long as you are on the “JobsMedia.ca network”.

IF YOU DO NOT WISH TO BE BOUND BY THIS CONTRACT, DO NOT NAVIGATE ON ONE OF THE WEBSITES from the JobsMedia.ca network. The terms and conditions of the contract may change at any time and they will automatically come into force.

 

1. Acceptance of the Conditions of use and posting methods

Welcome to the JobsMedia.ca website! By using the services offered by JobsMedia.ca, you accept the Conditions of Use and posting methods, as well as the conditions associated with managing possible amendments. We therefore suggest you to periodically consult the current Conditions of Use and posting method to be well informed and to accept the updated conditions and methods.

 

2. Services offered by JobsMedia.ca

JobsMedia.ca is a one-stop-shop that affects the world of work: job offers, job search assistance, information on professional training, relevant information in the world of work, as well as other information.

Detailed job descriptions offered by several companies and organizations, and description of training activities offered by public and private professionals are available on JobsMedia.ca. JobsMedia.ca also provides service suppliers and companies with a powerful tool to post their service offerings and their employment opportunities.

 

3. Copyright and trademarks

The logos of JobsMedia.ca and all its variations, the navigation tool and all contents of JobsMedia.ca are offered for non-commercial purposes. It is prohibited to use the logo or information contained at JobsMedia.ca for commercial or advertising purposes or to increase the volume of visitors to another website without the prior written permission from JobsMedia.ca.

JobsMedia.ca and other names, logos, and icons that are related to products and services from JobsMedia.ca are trademarks. Unless an exception is expressly stated, no elements of our service may be interpreted as granting you any right to use the intellectual property of JobsMedia.ca.

You are forbidden to neither modify, copy, distribute, transmit, disseminate, represent, reproduce, publish, license, transfer or sell any information, software, product or service obtained from the website, nor create derivative works from the aforementioned elements.

 

4. Username, password

You are responsible for maintaining the confidentiality of your username and password; JobsMedia.ca cannot be held in any case responsible for any unauthorized use of your account. Should the confidentiality of this information be compromised, please contact JobsMedia.ca by email as soon as possible to avoid any potential fraudulent use of your identity. JobsMedia.ca cannot be held liable for any damage or loss, particularly resulting of a non-compliance with the security measures described in this section. We strongly recommend that you read the LIMIT OF LIABILITY contained in clause 7 of these Conditions of use and posting methods to keep you well informed of the extent of your responsibilities regarding the services of JobsMedia.ca.

 

5. Use of online communication services

You are solely and fully responsible for the content of the messages you disseminate through our service and the consequences of those messages. You must not use this service to promote or offer for sale any goods or services for a commercial purpose (with the exclusion of training offers on JobsMedia.ca – Formations), conduct or send: study, competition, pyramid scheme or chain letters, spam, hack, solicit or perform any other illegal act. You are also forbidden from performing acts that could infringe on the rights of others and their enjoyment of the service. The activated services and plans must be used within the time limits prescribed by your plan. No refunds will be issued for unused services.

Although JobsMedia.ca reserves the right to delete certain data, all at its own discretion, this remains a faculty and not an obligation. JobsMedia.ca makes no statements regarding the control over the content of the available information, given the volume and transmission speed of data over the service.

 

6. Limit of liability

Search engines, directories, and content are provided free of charge by JobsMedia.ca without any guarantee as to the accuracy or availability of the websites. Likewise, JobsMedia.ca makes no claims as to the completeness of your search results. The information on the Internet is constantly changing, as well as the websites on which the information is published. It is therefore impossible to perform complete updates at all times. JobsMedia.ca cannot be held responsible for the lack of thoroughness of research or accessibility of a given website.

Moreover, JobsMedia.ca cannot guarantee the confidentiality of the information transmitted over the Internet and cannot be held responsible for potential damages caused by their disclosure. Therefore, you assume full responsibility.

You hereby agree that JobsMedia.ca cannot be held responsible for any direct or indirect damage resulting from the use of its services. Furthermore, you agree that all the information included on our websites is offered as is without any warranty as to the accuracy or liability of the content.

 

7. Network security and efficiency

JobsMedia.ca does not guarantee efficiency or total security. It is possible that a hacker manages to intrude on the server. It is therefore important to keep in mind, BEFORE OPENING A SESSION ON JobsMedia.ca, that it is always possible that a malicious person may access the servers of JobsMedia.ca and use, for his own purposes, certain personal information left by the members of the “website”.  IN NO CASE, neither JobsMedia.ca nor any of its administrators can be held responsible for acts of hacking or be blamed for any damage or loss that might result to a member of the “website”. The website of JobsMedia.ca may be subject to occasional breakdowns and certain programming errors that can be caused by updates or by events beyond the control of the administrators.

Neither the administrators nor members of the organization can be held responsible if a member finds himself unable to browse the “website” whatever the reason which prevents him to do so (misunderstanding, faulty telephone line, incompatible modem, broken cable, improper configuration, incorrect Browser, etc.).

 

8. Content ownership

You remain the copyright owner of the content that you submit to our service. However, you grant JobMedia.ca a license to use this content for distribution and promotion purposes. This license is granted to JobsMedia.ca by the sole act of transmitting your content to our services and is offered free of charge, non-exclusive and for continuous use. This license includes, among other things, the right to use, reproduce, copy, in whole or in part, and display the content on our services, unless expressly excluded.

You also agree that JobsMedia.ca reserves the right to remove information from its network if the content is deemed inappropriate or in violation of these Conditions of use and posting methods.

 

9. Failure to comply with the Conditions of use and posting methods

These Conditions of use and posting methods are put in place to protect our users and to maintain the quality of service. Be aware that any failure by yourself to comply with these Conditions of use and posting methods may result in the removal of your link to JobsMedia.ca.

 

10. Applicable law

This agreement on the conditions of service is governed by the law applicable in the province of Quebec. You hereby acknowledge that any dispute arising out of or in connection with the use of the services and websites of JobsMedia.ca will be submitted to the jurisdiction of the courts in the district of Montreal, province of Quebec.

 

11. Compensation

You hereby agree to side and defend JobsMedia.ca in the event that legal action is brought against JobsMedia.ca as a result of a violation of these conditions of service by yourself or any other user related to you.

 

12. Job and advertising posting for employers

1. Conditions of use
  1. JobsMedia.ca – Jobs: only one type of job offer per posting and per distribution. The services should be used within the specified period.
  2. JobsMedia.ca – Jobs: a  job post should represent a real opportunity in your organization. No post regarding a call for tenders or candidate database will be tolerated on the said websites. We reserve the right to delete any offer which does not appear to “meet this condition” without refund.
  3. JobsMedia.ca – Formations: only one type of course per posting and per distribution. The services should be used within the specified period.
  4. Web products: impressions are subject to availability. We reserve the right to modify our advertising products by notifying you at least 30 days in advance. The agreement does not include the creation of your advertising material. The advertising material must be provided in the language of the website in which it will appear. Gif, jpeg files and hyperlinks must be received no later than 5 working days before the start of the campaign. If the material is not received on time, JobsMedia.ca cannot guarantee the delivery according to the signed agreement.
2. Cancellation conditions
  1. A penalty fee of 50% will be charged in case of cancellation of any unlimited plan before the expiry date of said contract.
  2. No cancellation before the start date.
  3. No cancellation after the start date of the advertising campaign or the job offer posting will be refunded.
3. Payment
  1. The invoice is payable upon receipt.
  2. To avoid any late payment and deactivation of your account, please ensure that your payment reaches us no later than 30 days after receipt of the invoice (late payment charge: 2% per month, reactivation fee: $150).
  3. No job offer will be refunded once the position is posted.
  4. All plans are automatically renewed on the expiry date. The cancellation of renewal must be communicated before the automatic renewal, otherwise, the plan must be paid in full.
4. Subscription
  1. Products and services are purchased in the form of subscriptions for the duration indicated during the payment.
  2. Subscriptions can be added during a subscription period at the same price as the subscription price, in proportion to the part of the remaining subscription period by the time subscriptions are added, and
  3. Any added subscription will end on the same date as the underlying subscriptions.

 

13.  Conditions of use for external recruiters (Recruitment firms)

1. Conditions of use
  1. JobsMedia.ca – Jobs: only one type of job offer per posting and per distribution. The services should be used within the specified period.
  2. JobsMedia.ca – Jobs: a job post should represent a real opportunity in your customer’s organization. No post regarding a call for tenders, candidate database or general offers evoking the opening of several different positions will be tolerated on the said websites. We reserve the right to delete any offer which does not appear to “meet this condition” without refund.
  3. JobsMedia.ca – Jobs: A maximum of three offers per week per recruitment firm. Please note that the job offers posted with the logos of your clients are not limited.
  4. JobsMedia.ca – Jobs: The prices of the online store are applicable only for employers who hire internally. These prices are therefore not applicable for investment/recruitment firms who wish to post one of their customers.
  5. JobsMedia.ca – Formations: only one type of course per posting and per distribution. The services should be used within the specified period.
  6. Web products: impressions are subject to availability. We reserve the right to modify our advertising products by notifying you at least 30 days in advance. The agreement does not include the creation of your advertising material. The advertising material must be provided in the language of the website in which it will appear. Gif, jpeg files and hyperlinks must be received no later than 5 working days before the start of the campaign. If the material is not received on time, JobsMedia.ca cannot guarantee the delivery according to the signed agreement.

  1. Products and services are purchased in the form of subscriptions for the duration indicated during the payment.
  2. Subscriptions can be added during a subscription period at the same price as the subscription price, in proportion to the part of the remaining subscription period by the time subscriptions are added, and
  3. Any added subscription will end on the same date as the underlying subscriptions.

 

14. Posting language

In accordance with Article 41 of the Charter of the French language, all the job offers for positions established in Quebec must be posted in French (full content).

“According to the provisions of the Charter of the French language which has been the law in Quebec since 1977, French is the official language of Quebec. Therefore, any company that has or wishes to establish a business venture in Quebec must comply with the requirements contained in the Charter. Whoever does not comply to a disposition in the law or a ruling adopted by the Government in accordance with said Charter is in violation of the law and is subject to corrective measures from the Office québécois de la langue française, and eventually, to legal proceedings. JobsMedia.ca invites you to respect the law by including a complete description of your job posting in French.”

15. Conditions related to the use of links

JobsMedia.ca authorizes and encourages the insertion of hypertext links to its Internet homepage. You can establish a hypertext link that points back at JobsMedia.ca only if you have accepted the conditions applicable to links (“Conditions related to the use of links”) as described herein. By establishing such a hypertext link, you have automatically accepted these specific conditions:

  1. If you establish a hypertext link with its website, JobsMedia.ca grants you a license that is limited, non-exclusive, non-transferable, and loyalty-free that authorizes you to use the trademark and the Internet icons of JobsMedia.ca, if they are available (hereafter referred to as “Authorized Trademarks”) to the sole purpose of establishing a link between your website and the JobsMedia.ca website. As an exception to the limited license that allows you to use the Authorized Trademarks granted under this paragraph, it is strictly forbidden to use the trademarks or service marks of JobsMedia.ca (the “Marks”) for whatever reason without the prior written permission from JobsMedia.ca.
  2. You recognize that all rights with respect to the Marks, the content displayed on the website pages of JobsMedia.ca and the display of the website pages are the sole propriety of JobsMedia.ca. You must not at any time, be it directly or indirectly, contest or violate these rights.
  3. If you establish a hypertext link to the website of JobsMedia.ca, your website:
    1. cannot create a frame destined to surround any part of the website or use another technical method that may affect the visual integrity of the website;
    2. cannot imply that JobsMedia.ca has recommended you or recommended your products or services;
    3. cannot imply an affiliation between your company and JobsMedia.ca without prior written consent from JobsMedia.ca;
    4. cannot misrepresent the relation between you and JobsMedia.ca or give the false or erroneous impression regarding the services from JobsMedia.ca and
    5. cannot display content that may be construed as unpleasant or offensive, but solely content that may be accessible by all ages.
  4. JobsMedia.ca retains the right to export any link that it feels is relevant, that points to the website (homepage, postings, directories, etc.).
  5. JobsMedia.ca assumes no responsibility with respect to the content as it appears on your website.
  6. JobsMedia.ca can at any time and at its sole discretion, immediately terminate your license that allowed you to use the Authorized Trademarks and your right of establishing a link to its website, with or without reason. If JobsMedia.ca exercises this right, you must immediately remove all your links towards its website and cease using the Authorized Trademarks.

 

16. Conditions related to the integration of XML feed or RSS feed

If you use an XML feed or an RSS feed to have JobsMedia post your offers automatically, JobsMedia cannot guarantee that the execution will be done with perfection at all times. 

Note that if you change your ATS provider or you change anything on your career page, in your RSS feed, or in your XML feed, the integration will have to be redone, and JobsMedia will have to charge you for this service. 

This is a new condition.

It has been agreed upon that these Conditions of use and posting methods can be modified in whole or in part by JobsMedia.ca at any time and without prior notification. By entering and browsing the “website”, you agree to comply with the said Conditions of use and posting methods as defined on the page of Conditions of use and posting methods on the website of JobsMedia.ca.
